1. Acceptance of Terms
By accessing or using Castora ("the Service"), operated by Castora ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
These terms apply to all users of the Service, including casting teams, performers, reviewers, and visitors.
2. Description of Service
Castora is an async audition platform that enables casting professionals to publish audition briefs, collect performer submissions, score submissions collaboratively, and manage the casting workflow. The Service includes the web application at app.getcastora.com and the marketing website at getcastora.com.
3. Account Terms
- You must be at least 16 years old to use the Service.
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Infringe on the intellectual property rights of others.
- Upload or distribute malicious software, viruses, or harmful code.
- Harass, abuse, or threaten other users.
- Submit false, misleading, or fraudulent information.
- Attempt to gain unauthorised access to other users' accounts or data.
- Use automated systems (bots, scrapers) to access the Service without our written permission.
- Interfere with the proper functioning of the Service.
- Use the Service for any purpose other than its intended casting and audition functionality.
5. Content and Intellectual Property
5.1 Your content
You retain ownership of all content you upload to the Service, including audition briefs, scripts, video submissions, images, and documents ("Your Content"). By uploading content to the Service, you grant us a limited licence to store, process, and display Your Content as necessary to provide the Service.
5.2 Performer submissions
Performers retain ownership of their submissions. By submitting content to an audition, performers grant the casting organisation a licence to view, evaluate, and discuss the submission for the purposes of the casting process. This licence does not transfer ownership or grant rights to use submissions for any purpose beyond evaluation.
5.3 Our intellectual property
The Service, including its design, features, code, documentation, and branding, is owned by Castora and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
6. Payment Terms
- Paid plans are billed monthly or annually, as selected at the time of subscription.
- Prices are displayed in GBP and are exclusive of applicable taxes.
- Payment is processed securely through Stripe. We do not store your full payment card details.
- Subscriptions renew automatically unless cancelled before the renewal date.
- We may change pricing with 30 days' notice. Price changes do not affect existing billing periods.
- Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.
7. Free Plan
The free plan provides limited access to the Service at no cost. We reserve the right to modify the features or limits of the free plan at any time. Free plan users are subject to the same terms as paid users.
8. Cancellation and Termination
8.1 Cancellation by you
You may cancel your subscription at any time from your account settings. Upon cancellation:
- Your subscription remains active until the end of the current billing period.
- You retain access to your data until the end of the billing period.
- After the billing period ends, your account reverts to the free plan.
8.2 Termination by us
We may suspend or terminate your account if you:
- Violate these Terms of Service.
- Engage in fraudulent or illegal activity.
- Fail to pay applicable fees after reasonable notice.
We will make reasonable efforts to notify you before termination, except in cases of serious violations.
8.3 Effect of termination
Upon account termination, we will delete your data within 30 days, except where retention is required by law. You may request an export of your data before termination takes effect.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Castora harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third party's rights.
11. Dispute Resolution
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or the Service shall be resolved in the courts of England and Wales.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation is unsuccessful, either party may pursue formal resolution.
12. Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes that affect your use of the Service. Continued use after changes take effect constitutes acceptance of the modified terms.
14. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the Service. The updated terms will be effective from the date posted, and your continued use of the Service constitutes acceptance of the updated terms.
15. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
